Terms of Service

These Terms govern your use of Spokecast (the “Service”), operated by Spokecast. By creating an account, buying credit, or sending through the Service, you agree to them on behalf of yourself and the organization you represent (“you” or “Customer”).
1. What Spokecast is
Spokecast is a technology platform that produces personalized videos from material you provide: a recorded spokesperson clip, a consented voice sample, your scripts, your recipient data, and your branding. Spokecast renders videos and hosts durable share links. Spokecast is a software and media vendor. It is not your agent, not a messaging carrier, and not the sender of any communication you deliver to recipients.
2. Billing (campaign setup and generation batches)
Billing has two parts. Each campaign begins with a one-time $100 setup fee that includes 300 videos. Additional videos are purchased as prepaid generation batches: you buy a quantity of videos in advance, and the per-video rate is set by the size of that single purchase — $0.30 each below 1,000 videos, $0.25 each from 1,000 through 9,999, and $0.20 each at 10,000 or more. Batch orders have a 34-video minimum ($10.20 at the $0.30 rate). The setup fee, purchased batches, and all videos produced are nonrefundable.
- Charges are always computed by Spokecast from your account and campaign state at the time of each payment; you are never charged an amount supplied by your browser.
- Generation batches are credited to your account, not to a single campaign. Any campaign you run can draw on your batch balance, and batch videos never expire.
- The 300 videos included with a campaign's setup fee belong to that campaign and are used before any batch videos are drawn. The included videos do not transfer between campaigns.
- The setup fee, purchased batches, and every video produced are nonrefundable.Because each video is produced on demand for you, there is no refundable balance. If the Service fails to produce a video within an allowance or batch you paid for, that allowance is retained so you can run it again.
- Spokecast may change pricing prospectively with notice. Changes do not affect a campaign you have already funded or a batch you have already purchased.
3. Your account and acceptable use
You are responsible for your account credentials, your API keys, and all activity under them. You agree not to use the Service to produce content that is unlawful, that impersonates a person or entity you are not authorized to represent, or that violates the rights of others. Spokecast may suspend or terminate access for a breach of these Terms or where it reasonably believes use of the Service may violate law or carrier policy.
4. Recipient consent and list integrity
Messages that carry AI-generated or cloned-voice content are regulated. Before each send, you certify, and these Terms bind you to, each of the following:
X.1 Consent
Every recipient telephone number gave prior express written consent, in a signed agreement obtained without coercion or purchase conditioning, to receive automated, AI-voice, or prerecorded messages from your campaign at the number listed. You have retained documentation of each consent record.
X.2 List integrity
Your list has been scrubbed against your internal do-not-contact and suppression lists. It excludes any number that has opted out or sent STOP, and any number for which you cannot produce documented consent. You honor opt-out requests within ten business days.
X.3 Records
You retain complete consent records for at least five years from the later of the last send or the date consent was obtained, and you will produce them to Spokecast within five business days of a request. Inability to produce records for a recipient is a material breach.
X.4 You determine compliance; you indemnify
Spokecast provides technology only and does not provide legal advice. You are solely responsible for compliance with the TCPA, FCC rules, CTIA messaging principles, applicable state law, and FEC and state campaign-finance disclaimer requirements, and for obtaining your own legal counsel. You agree to indemnify, defend, and hold harmless Spokecast from any claim, damage, penalty, or fee arising from your failure to obtain consent, your failure to honor opt-outs, your violation of those laws or policies, or the content of your messages and linked media. This obligation survives termination.
5. Content you upload
Y.1 Person and voice rights
You warrant that you hold all rights to every spokesperson clip and voice sample you upload, and that the person recorded gave written consent to the creation and use of an AI voice replica and likeness for the messages you produce. You will provide proof of that consent on request.
Y.2 Uploaded B-roll rights
You warrant that you hold all rights, licenses, and permissions to any B-roll, images, music, or other media you upload, for the use you make of it in the Service.
Y.3 Content indemnity
You indemnify, defend, and hold harmless Spokecast from any claim arising from material you upload or the content you produce, including claims of infringement, defamation, or violation of publicity or privacy rights. This obligation survives termination.
6. Spokecast-sourced assets
Z.1 Representation
Where Spokecast sources B-roll, images, or music on your behalf, Spokecast represents that those assets are appropriately licensed solely as incorporated into videos produced through the Service. That license does not permit you to extract, redistribute, or resell a sourced asset on its own, separate from the video in which it appears.
7. Political messaging
P.1 Disclaimers are yours
Any “paid for by” or sponsor-identification disclaimer required by federal or state law is your responsibility to include, in your message and your video content.
P.2 Sponsor identification
You will identify the responsible campaign or committee as required by applicable law, and you warrant your registrations (including Campaign Verify and 10DLC, where applicable) are valid for your sends.
P.3 Prohibited content
You will not use the Service to impersonate an opponent, a government official, or an election authority, to suppress voting, or to distribute content prohibited by carrier policy or law.
P.4 Technology vendor only
Spokecast is a technology and media vendor. It does not endorse any candidate, campaign, or message, and it is not a contribution conduit or fundraising processor.
P.5 AI-content disclosure
Many jurisdictions require disclosure that political content was generated or substantially altered using artificial intelligence. You are responsible for including that disclosure wherever it is required, and Spokecast recommends including it by default.
8. Warranties and liability
The Service is provided “as is.” To the maximum extent permitted by law, Spokecast disclaims implied warranties and is not liable for indirect, incidental, or consequential damages. Spokecast's total liability for any claim is limited to the amount you paid for the Service in the ninety days before the claim arose.
9. Changes and contact
Spokecast may update these Terms; material changes take effect on notice. Questions go to support@spokecast.com.
